2. Scope and Acceptance
These Terms and Conditions govern the distance sales contract entered into between the Seller and the consumer using the website www.singularleather.com (the "Customer"), under the terms of Decree-Law no. 7/2004 (e-commerce), Decree-Law no. 24/2014 (distance contracts), Decree-Law no. 84/2021 (legal guarantee) and Law no. 24/96 (consumer protection).
Placing an order implies full acceptance of these Terms and of the Privacy Policy.
3. Products
The products sold are handcrafted leather goods, which may include personalization (engraving). As these are handmade goods using a natural material, they may show small variations in colour, texture or pattern which do not constitute defects but are inherent characteristics of the material.
We make every effort to display colours and images as accurately as possible; however, reproduction may vary depending on the user’s screen and this does not constitute a lack of conformity.
4. Prices and VAT
Prices are expressed in euros (EUR), include VAT at the legal rate in force in Portugal and, unless otherwise stated, do not include shipping costs. Shipping costs are clearly displayed before checkout.
For shipments to other EU Member States, we apply the One-Stop Shop (OSS) scheme and the VAT rate of the destination country where applicable. For shipments outside the EU, customs duties and taxes may be charged in the destination country and are the sole responsibility of the Customer.
In the event of a manifest pricing error ("obvious error"), we reserve the right, before dispatch, to inform the Customer and propose a solution, and the contract may be cancelled by mutual agreement.
5. Formation of the Contract
The contract is deemed concluded when the Customer receives the order confirmation by email. Until that moment, the Seller reserves the right to refuse orders in duly justified exceptional situations (suspected fraud, stock unavailability, manifest pricing error).
Under Article 31 of Decree-Law 7/2004, the Customer may access the terms of the contract and the Privacy Policy at any time via the website.
6. Payment
We accept the payment methods indicated at checkout: credit/debit cards (Visa, Mastercard, American Express, Maestro), MB WAY (where available), PayPal, Apple Pay, Google Pay, Shop Pay, Bancontact, iDEAL/Wero and Union Pay.
All transactions are processed in a secure environment with SSL encryption, through PCI-DSS certified payment processors. In accordance with the PSD2 Directive, strong customer authentication (SCA) methods may be required.
7. Invoicing
We issue an electronic invoice for all orders using software certified by the Portuguese Tax Authority. The Customer may enter their Tax ID (NIF) at checkout, and it will be mandatorily included on the invoice.
8. Shipping and Delivery Times
The average production and dispatch time is 2 to 3 business days from payment confirmation. Total delivery time depends on the carrier and destination. Detailed timeframes are set out in the Shipping Policy.
If, for reasons not attributable to the Customer, it is not possible to meet the indicated delivery time, the Seller undertakes to inform the Customer in good time, and the Customer may terminate the contract with a full refund.
9. Right of Withdrawal
The Customer has the right to withdraw from the contract within 14 consecutive days from delivery of the goods, under Decree-Law no. 24/2014, as detailed in the Returns and Right of Withdrawal Policy.
Legal exception: Under Article 17(1)(c) of Decree-Law 24/2014, this right does not apply to personalized goods (wallets with engraving or personalization requested by the consumer), except in the event of defect or non-conformity.
10. Statutory Conformity Guarantee
You benefit from the 3-year statutory guarantee provided for in Decree-Law no. 84/2021. In the event of lack of conformity, you are entitled to restoration free of charge through repair, replacement, price reduction or termination of the contract, as described in the Returns Policy.
11. Liability
The Seller is liable under the applicable legislation, in particular Decree-Law no. 84/2021 and Law no. 24/96. Nothing in these Terms excludes or limits the Seller’s liability for wilful misconduct or gross negligence, or for damage caused to the Customer’s life or physical integrity.
12. Personal Data
The processing of personal data arising from use of the website and conclusion of the contract is subject to the Privacy Policy.
13. Intellectual Property
All content on the website (texts, images, logos, designs, photographs, videos) is owned by the Seller or used under licence and is protected by the Portuguese Copyright and Related Rights Code. Reproduction, distribution or public communication without prior express authorization is prohibited.
14. Customer Reviews
The reviews published on the website come from customers who have actually purchased our products, via the Judge.me platform, which links each review to a confirmed order. We do not delete legitimate negative reviews; we only remove illegitimate content (insults, third-party personal data, spam, unlawful content).
15. Governing Law and Jurisdiction
These Terms and the contract concluded are governed by Portuguese law, without prejudice to any more favourable mandatory consumer protection provisions under the law of the Customer’s habitual residence within the European Union (Article 6 of Regulation (EC) no. 593/2008 — Rome I).
For the judicial resolution of any disputes, the court of the consumer’s domicile has jurisdiction, without prejudice to the alternative dispute resolution mechanisms indicated below.
